Whisper Bloom NYC LLC ("Whisper Bloom," "we," "us," or "our") is a limited liability company organized under the laws of the State of New York, with its principal place of business in Manhattan, New York.

By visiting our Site, placing an order, or engaging with any content or service offered by Whisper Bloom, you confirm that you are at least 18 years of age and agree to these Terms in full. If you do not agree, you may not use this Site.

3. Products and Artisanal Nature

All products sold by Whisper Bloom are handcrafted in limited quantities. As stated throughout our Site:

Each piece is artisanal and contains natural crystals; slight variations are signs of soul.

By completing a purchase, you acknowledge and accept that natural and handmade products will exhibit variation, and that such variation is inherent to the product, not a manufacturing defect.

4. Intellectual Property

All content on this Site — including but not limited to: the Whisper Bloom name and wordmark, all logos and visual identity elements, product photography, editorial copy, brand narrative, and the Whisper Bloom Soul Assessment (a proprietary five-question diagnostic tool) — is the exclusive intellectual property of Whisper Bloom NYC LLC.

The Soul Assessment, its methodology, question architecture, and resulting product recommendations are proprietary and protected. Reproduction, adaptation, or commercial use of any portion of this content without express written permission is strictly prohibited and may constitute infringement under applicable federal and state law.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

6. Limitation of Liability

To the fullest extent permitted by law, Whisper Bloom NYC LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or Site. Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.

7. Modifications

We reserve the right to amend these Terms at any time. Continued use of the Site following any revision constitutes acceptance of the updated Terms. The effective date at the top of this document will reflect the most recent revision.
